The Fitness for Duty Program was developed to enhance the ability of contractor members to comply with Pennsylvania’s Act 34 and Act 151 laws which require all employees on school and certain other properties to obtain PA Criminal Record Checks and Child Abuse History Clearances.

These Record Checks and Clearances are handled by a Third Party Administrator. The Administrator sends renewal applications, keeps track of all current jobs requiring these clearances, maintains the records and a database in a central office, and distributes the clearances to the necessary jobsites on the contractor’s behalf.

In 2019, the MCACP developed a first of its kind in the industry “Crystalline Respirable Silica and Respiratory Protection Program” which assists the contractor with some of the costs and recordkeeping required by OSHA to protect workers from the respirable harms of silica.

Contractors using these programs must be members of MCACP (application available here); read the Joinder Letter and sign a joinder for the FFD program.
